VITA Board of Directors Accepts Ex Ante (IP) Procedures Print E-mail

The VITA BOD just accepted the proposed ex ante intellectual property (IP) procedures, clearing the way for a member vote at the VSO meeting in January 2007.

The following comes from Ray Alderman in a letter today to the VITA membership: -C2

Hello Members:

For the past 3 weeks, the VITA Board of Directors has been considering the ex ante procedures previously submitted to the US Department of Justice. The DOJ delivered their positive Business Review Letter to us in October. The VITA Board has reviewed these new procedures and the DOJ BRL with their attorneys, and submitted their votes today on the following resolution:

"The Board of Directors of VITA resolves to accept the ex ante procedures, with guidance provided by the US Department of Justice Business Review Letter, and refer these procedures to the VITA Standards Organization for adoption or rejection, according to VSO voting rules. Furthermore, when VSO adopts these procedures by vote, modifications and additions will be made to the Membership Agreement to reflect these new procedures."

We have 6 companies on the VITA Board. Each BOD member voted. The results are 5 (yes) and 1 (no) vote. This resolution is hereby adopted.

The ex ante procedures will now go to the VITA Standards Organization (VSO) for ballot on 17 January 2007 for adoption or rejection. If adopted by the VSO with a 2/3 majority vote, the procedures will become active on 17 January 2007, and will be submitted to the ANSI Executive Standards Council (ExSC) for review and approval. If you have not read the new VSO procedures concerning patents and intellectual property in standards, you can go to <www.vita.com> and click on the green lightbulb on the right side of the screen for the DOJ letter and the procedures reviewed by DOJ. After adoption by the VSO, each member company will receive a new membership agreement that must be signed and returned to VITA, signifying that you are aware of these procedures and accept them.
